Errata Sheets in Massachusetts are governed statutorily by Massachusetts Rules of Civil Procedure Rule 30(e). Mass. Gen. Laws Ann. ch. 5, § 30 (West 2017). Rule 30(e) requires the transcript be submitted to the witness to be examined once it is completed unless the parties mutually waive the examination. Id. The witness can make changes to the transcript in either form or substance as long as a list of reason(s) for the change(s) accompanies the changes. Id. The witness shall then sign the deposition within 30 days of when it was submitted to the witness, unless the parties mutually agree to waive the signature. Id. If the witness refuses to sign or cannot sign, the deposition officer shall sign the transcript and it will be considered as fully signed. Id.
